Agreement to Terms
By accessing or using AccessGuard ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
Description of Service
AccessGuard provides automated website accessibility scanning to help identify potential WCAG and ADA compliance issues. The Service analyzes publicly accessible web pages and generates reports highlighting accessibility violations.
Acceptable Use
You agree to use the Service only for lawful purposes. You may not:
- Scan websites you do not own or have permission to scan
- Use the Service to harass, threaten, or intimidate others
- Attempt to overwhelm our systems with excessive requests
- Use automated tools to abuse or exploit the Service
- Reverse engineer or attempt to extract our source code
- Resell or redistribute scan results without permission
Scan Limitations
The Service scans only publicly accessible pages. We do not scan pages behind authentication, private networks, or content that requires login credentials. Scans are limited to prevent abuse — excessive scanning may result in temporary or permanent restrictions.
Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind.
AccessGuard scan results are informational only and do not constitute legal advice. Our scans may not detect all accessibility issues, and the absence of detected violations does not guarantee ADA or WCAG compliance.
We recommend consulting with accessibility experts and legal professionals for comprehensive compliance assessments.
Limitation of Liability
To the maximum extent permitted by law, AccessGuard and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Legal fees or settlement costs
- Damages arising from reliance on scan results
- Service interruptions or data loss
Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify and hold harmless AccessGuard and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these terms.
Intellectual Property
The AccessGuard name, logo, and Service are protected by intellectual property laws. Scan reports generated for you may be used freely for your own purposes, but the underlying technology and methodology remain our property.
Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties.
Governing Law
These terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
